Welcome to the Aearth Living Wall App ("App"), operated by Eren Tetik ("Company," "we," "us," or "our"). By downloading, installing or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Grant of License

• 2.1 Subject to your compliance, Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on compatible devices for personal or internal business purposes.
• 2.2 All rights not expressly granted are reserved by Company.

3. User Conduct

You agree not to:

• Reverse-engineer, decompile, disassemble or otherwise attempt to derive the App's source code.
• Modify, adapt, create derivative works of, or sublicense the App.
• Use the App in any unlawful manner or to violate any applicable laws.
• Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.

4. Intellectual Property

All content, graphics, logos, trademarks, and software within the App are the exclusive property of Company or its licensors and are protected by copyright, trademark and other intellectual property laws. The name "Aearth" and the Aearth logo are registered trademarks of Eren Tetik.

5. Third-Party Services

The App may integrate with third-party services (e.g., weather APIs, analytics providers). Your use of those services is subject to their own terms and policies. Company is not responsible for their availability or performance.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS-IS" AND "AS-AVAILABLE," WITHOUT WARRANTY OF ANY KIND. COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. COMPANY'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNT PAID BY YOU TO DOWNLOAD THE APP.

8. Indemnification

You agree to defend, indemnify and hold harmless Company, its affiliates and their officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the App.

9. Termination

• 9.1 These Terms remain effective until terminated.
• 9.2 Company may suspend or terminate your access at any time for violation of these Terms or for any other reason.
• 9.3 Upon termination, all rights granted to you will immediately cease and you must uninstall and delete all copies of the App.

10. Changes to Terms

Company may modify these Terms at any time. We will update the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the courts located in İzmir, Türkiye, and you consent to personal jurisdiction and venue there.

12. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
